Terms of Use — East Coast Wildlife Checklist

These Terms of Use ("Terms") govern your use of the East Coast Wildlife Checklist mobile application (the "App"), provided by Vision Walks Eco Tours Pty Ltd ("we", "us", "our"). By downloading, accessing or using the App you agree to these Terms. If you do not agree, do not use the App.

1. The service

The App is a free field checklist that lets you browse a curated list of wildlife species found on Australia's east coast, record which species you have seen, keep private notes, view distribution maps, and add species of your own.

We may change, suspend or discontinue any part of the App at any time.

2. Your account

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for activity that occurs under your account. You must be at least 13 years old to create an account (or older, where required by the laws of your country).

You may delete your account at any time from the profile screen in the App.

3. Your content

You retain ownership of the notes, species entries and photographs you add ("Your Content"). You grant us a limited, non-exclusive licence to store, process and display Your Content for the sole purpose of operating the App and providing the service to you, and to include it in the internal summary reports described in our Privacy Policy.

You must not upload content that:

• you do not have the right to upload;
• is unlawful, defamatory, obscene, hateful or harassing;
• contains personal information about another person without their consent; or
• contains malicious code.

Your Content is private to your account and is not shown to other users. We may remove content that breaches these Terms.

4. Acceptable use

You must not:

• use the App for any unlawful purpose;
• attempt to access accounts, data or systems that are not yours;
• interfere with, overload or disrupt the App or its infrastructure;
• reverse engineer, decompile or scrape the App except to the extent permitted by law;
• use the App or its data for commercial resale without our written permission.

5. Wildlife safety and accuracy

The App is provided for general interest and education only.

• Species descriptions are generated automatically and may contain errors. They must not be relied on for identification of dangerous or venomous animals, for medical decisions, or for any scientific, regulatory or conservation purpose.
• Distribution maps are approximate.
• Always observe wildlife from a safe distance, follow local laws and park regulations, and never handle, feed or disturb wild animals.

You are responsible for your own safety when in the field.

6. Third-party content and links

The App displays photographs from Wikimedia Commons and map data from OpenStreetMap, each subject to their own licences, and links to visionwalks.com.au. We are not responsible for third-party content or websites.

7. Availability

The App depends on an internet connection and on third-party platforms. We do not guarantee that the App will be available, uninterrupted or error-free.

8. Intellectual property

The App, its design, its curated species list and our trade marks are owned by us or our licensors. Except for Your Content, nothing in these Terms transfers any intellectual property rights to you.

9. Disclaimers and liability

To the maximum extent permitted by law, the App is provided "as is" and we exclude all warranties not expressly stated in these Terms.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited, it is limited (at our option) to re-supplying the service or paying the cost of having it re-supplied.

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential loss, loss of data, or loss arising from your reliance on species information in the App.

10. Termination

We may suspend or terminate your access if you breach these Terms. You may stop using the App and delete your account at any time.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.

12. Changes

We may update these Terms. The "Last updated" date shows when they were last changed. Continued use of the App after a change means you accept the updated Terms.
